This agreement is concluded between you and KNDR lab, Linzerstraße 119, 4600 Wels, Austria — not with Apple. KNDR lab alone is responsible for the Puttor app and its content.

Licence

You are granted a non-exclusive, non-transferable, revocable licence to use Puttor on any device that you own or control, subject to the Apple Media Services Terms and Conditions. The app is licensed, not sold.

What is not permitted

• Reverse engineering, decompiling or disassembling, except where mandatory law allows it
• Renting, lending, reselling, sublicensing or otherwise distributing the app
• Removing or altering copyright notices
• Using the app for unlawful purposes

Puttor Pro

Puttor is free to download and use with the features of the free version. Further features are unlocked with Puttor Pro, available as an in-app purchase in two forms:

• Yearly subscription: renews automatically for another year each time unless it is cancelled. It may begin with a free trial; its length is shown in the app before purchase.
• One-time purchase (Lifetime): a single payment with no further charges.

The current prices, the scope of Puttor Pro and any free trial are shown in the app before you buy.

Payment is charged to your Apple ID when you confirm the purchase, or at the end of a free trial. A subscription renews automatically at the then current price unless it is cancelled at least 24 hours before the end of the current period; the renewal is charged within 24 hours before that period ends. You can manage and cancel the subscription at any time in your App Store account settings; deleting the app does not cancel it. After cancellation, Puttor Pro remains available until the end of the period already paid for. Any unused part of a free trial ends when you buy the one-time purchase.

Purchases are processed by Apple and are subject to the Apple Media Services Terms and Conditions. Refunds are handled by Apple (reportaproblem.apple.com). Purchases are tied to your Apple ID and can be restored on other devices with "Restore purchases". Rounds you have entered remain yours and stay readable even without Puttor Pro. Mandatory consumer rights remain unaffected.

Rights in the app

All rights in Puttor, its source code, design and content remain with KNDR lab. The data you enter is yours and stays on your device.

Maintenance and support

KNDR lab alone is responsible for maintenance and support, reachable at office@kndr-lab.com. Apple has no obligation in this respect.

Warranty

Statutory warranty rights apply. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation.

Accuracy of the analysis

Puttor is a training tool. Its calculations rest on published tour reference figures and on the data you enter yourself. They do not constitute advice, and no guarantee is given that they will produce any particular result or improve your game.

Liability

KNDR lab is liable without limitation for intent and gross negligence, under the Austrian Product Liability Act, and for injury to life, body or health. For slight negligence, liability is limited to foreseeable damage typical of this type of contract; within that limit, liability for lost profit, data loss and consequential damage is excluded. Mandatory consumer rights remain unaffected.

Keeping backups of your data is your own responsibility.

Third-party claims

KNDR lab, not Apple, is solely responsible for addressing any third-party claims relating to the app, including claims of intellectual property infringement.

Export and legal compliance

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Termination

This agreement ends when you delete the app; a Puttor Pro subscription must be cancelled separately in your App Store account settings. Your licence terminates automatically upon any material breach of these terms.

Apple as third-party beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of this agreement and have the right to enforce it against you.

Governing law

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory provisions and courts of their country of habitual residence apply; otherwise the place of jurisdiction is Wels, Austria.
